Texas & Houston
Texas crypto and digital-asset counsel.
From our Houston office at 440 Louisiana Street, Crypto Law Hub advises companies on Texas money-transmission questions, digital-asset custody rules, mining and energy agreements, and Texas securities matters.
What We Do
Texas rules, Texas projects.
- Money transmission — whether your activity requires a Texas money transmission license, applying the Texas Department of Banking’s Supervisory Memorandum 1037.
- Stablecoin and payment products — how Texas treats stablecoin activity and customer-fund handling for payment businesses.
- Custody and customer assets — segregation and reporting requirements for digital-asset service providers serving Texas customers.
- Mining and energy — commercial, hosting and power agreements for Bitcoin mining operations.
- Bitcoin ATM and kiosk operations — licensing and compliance questions for kiosk operators.
- Texas securities — registration and enforcement questions before the Texas State Securities Board.
The Landscape
Welcoming, with real rules.
Texas has positioned itself as open to digital-asset businesses, and its banking and securities regulators actively apply existing law.
- SM 1037 — the Texas Department of Banking’s guidance on when virtual currency activity is money transmission, most recently revised January 28, 2025, including its treatment of stablecoins.
- HB 1666 — effective September 1, 2023, it requires certain digital-asset service providers serving Texas customers to segregate customer assets and report on their holdings.
- Texas State Securities Board — the TSSB has brought numerous enforcement actions against fraudulent crypto investment schemes.
- Federal overlay — GENIUS Act, FinCEN, SEC and CFTC requirements apply alongside Texas law. See U.S. regulatory counsel.
Who It’s For
For companies with Texas operations.
- Texas founders — building digital-asset businesses in Houston, Austin, Dallas and across the state.
- Exchanges and payment apps — serving Texas customers.
- Mining and energy companies — structuring hosting, power and equipment arrangements.
- Investors — evaluating Texas-based digital-asset projects.
When to Call
- Before serving Texas customers — so licensing questions are answered first.
- Before launching a stablecoin or payment product — given SM 1037’s treatment of stablecoins.
- When structuring mining or hosting deals — before you sign.
- When the TSSB or Department of Banking contacts you — before you respond.
Next Step
Two ways to start.
